The International Legalization of Sex-Work: Protecting Sex-Workers from Abuse and Exploitation Through Increased Regulation and Decreased Stigmatization

- Sex-work is one of the world’s oldest professions and, to this day, exists in every nation throughout the globe. Through social media, online sexwork has increased the availability and diversity of sex-work. However, the legalization of sex-work is still a hotly debated topic amongst legal scholars and feminist theorists. Debate on sex-work revolves around the morality of commercial sex and the best system to protect [primarily] women from the exploitation of [primarily] male clients. However, due to the subjective and ever-changing understandings of morality, the legality of sex-work internationally must be based upon evidence concerning the best practices to protect sex-workers. Three central models exist globally to address the legality of sex-work: criminalization, decriminalization, and legalization. This note will argue that models of criminalization and decriminalization employed by countries such as China, Russia, Sweden, and the United States fail to properly protect sex-workers from abusive clients, exploitation of law enforcement agents, trafficking, and other safety and health related concerns. Sex-work must be legalized on an international level to protect sex-workers from exploitation and violence through government regulations. This note examines the legal structures addressing sex-work across the globe, including models of legalization in the Netherlands and Germany as primary examples of the implementation and effects of legalization.
